Newsom's Position Crumbles!?

Now, maybe you will begin to understand why I don't trust the NCCA officers to operate in a proper and legal fashion. The following statement was published on the NCCA website yesterday, 8-26-10.

"Anyone who is an adult and a resident of North Carolina must be an NCCA member to play in the NC Open or other NCCA sanctioned events."

NCCA President Gary Newsom has a bad habit of arbitrarily making up rules as he goes along, generally without the agreement of other officers nor consensus  of the members? In fact, in yet another desperate act to prevent me from participating, within the past 24 hours, after is had already been published for more than one month, the online TLA was mysteriously changed to include the above statement?? Regardless, those terms which are published in the Chess Life Magazine are the requirements which they must honor. (I will make sure to bring a copy with me when I enter).

When one observes the Articles of Incorporation of the NCCA, (which, I am told, have never even been "ratified" by the members), nowhere can any reference be found to circumstances associated with a member who "renounces" his membership. Nor does it indicate that a non-member can not re-join again if he  decides to "un-renounce" his membership!?

The hastily decreed, after the fact, composition, declaration and enforcement of rules to prevent a USCF member from participating is a perfect example of that which the rulebook strictly forbids, ie. P. 235, h. "Attempting to interfere with the rights of any USCF member, such as by barring someone from entering a USCF-sanctioned event for personal reasons."

Again, their Chess Life magazine advertisement specifically indicates that "non-members pay $69. And, as you are aware, a copy of their TLA was sent back to them for verification before publication. To attempt to change the rules after the fact is arbitrary and illegal.

I request that someone from the USCF send me an "official statement" concerning my right to participate in the NC Open and future NCCA events. Look, if it is absolutely necessary, I will pay the extra $5 and join again! Where does it state in their "By-laws" that I can't? Not accepting my $5
endorses a "catch 22" paradox which sanctions exclusion? And, that is wrong?

Personal vendettas by unscrupulous organizers who deny a USCF member's right to participate in tournament competition are clear violations of the published USCF rules and must be addressed and prevented. Furthermore, organizers who intentionally violate the rights of USCF members must be eliminated.
